Claims and claim avoidance
This paper sets out to deal with how claims arise in both pre- and post-contract phases of a project. It then goes on to deal with how, by good practice and procedure, claims can be avoided or at least minimised. A brief review of the effect of collaborative approaches on the industry has been added to indicate the effect that this may have on the incidence of claims. Lastly, it covers suitable claims procedures. The paper does not seek to cover the quantifying of claims.
